Anna Whites, a Frankfort lawyer, sent a letter to Governor Beshear and SOS Adams on Friday asking for additional executive orders related to the primary on Tuesday.
Whites, who has done legal work for the Kentucky Democratic Party and other political entities over the years, sent the following requests in her letter.
Re: Significant concerns with voter access and information
Gentlemen:
I am writing to request that you issue a Joint Emergency Order or other emergency order addressing several voter issues related to access for the primary election, June 23, 2020.
- Voters who applied for ballots but have not received them and wish to go ahead and vote. Please order that these voters may vote in person, either absentee (pre-election day) or on election day.
- Voters who absentee ballot is damaged in some way. Please order that the voters may vote in person, either absentee (pre-election day) or on election day.
- Voters who have received an absentee ballot but wish to vote live. Clerks are relying on KRS 117.085(7) to deny these voters the right to vote live. Please order that these voters may vote in person, either absentee (pre-election day) or on election day.
- In Fayette County, the language on the Clerk’s website indicates that only those with “special needs” may vote in person, either absentee or on election day. This is not a correct statement of the law.
Fayette Clerk Don Blevins refuses to correct this language. He stated that the incorrect language is purposeful as he does not “want the hordes” to vote live. Please require removal of this language, as the time has expired to request an absentee ballot and this language clearly has a chilling effect on voters.
